Identity documents for Luxembourg nationals

The new electronic identity cards, equipped with the latest graphic and electronic security mechanisms, have been available since 1 July 2014.

In addition, any citizen of legal age can have two certificates on their identity card enabling them to:

• sign documents and transactions online electronically
• connect securely to a wide range of government and private online applications.

Activation of these certificates is optional, and the decision to do so is made by the citizen at the time of application. To take advantage of this service, citizens must also accept LuxTrust's terms and conditions of sale.

It should be noted that current identity cards will remain valid until their expiry date and will only be renewed under the conditions laid down for a replacement.

APPLYING FOR A NEW ELECTRONIC IDENTITY CARD

The citizen must go in person to the municipal population office, with proof of payment and the old identity card or, if applicable, the declaration of loss. In the case of a minor or incapacitated adult, the application must be made by a parent exercising parental authority or, where applicable, by the guardian.

Taking the photo
The photo on the card is taken on site. If you wish to use a photo taken by a professional photographer (in accordance with OACI standards), you must apply to the CTIE (11 rue Notre-Dame, L-2240 - Luxembourg).

Normal and accelerated procedures
The normal time limit for issuing identity cards is 10 working days from the date of application. Under the accelerated application procedure, an identity card can be issued 3 working days after the day of application. In the case of an accelerated procedure, the card is issued at the CTIE (11 rue Notre-Dame, L-2240 - Luxembourg) and the applicant must first pay the fee plus €45.

Proof of payment
All applications must be accompanied by proof of payment of the tax to the State. When submitting their application, citizens must also indicate:

• whether they wish to use the accelerated procedure ;
• whether they wish to have their spouse's name added to their identity card;
• whether they wish to activate the certificates contained on their card.

ISSUING IDENTITY CARDS

In the normal procedure, identity cards will be issued by the municipality of residence. When an identity card is issued, the citizen must present:

• the receipt issued at the time of enrolment by the commune or by the CTIE ;
• where applicable, the old identity card or, failing that, a declaration of loss, theft or destruction issued by the Police.

PROCEDURES FOR RENEWING AN IDENTITY CARD

The electronic identity card must be renewed in the following cases:

• expiry of the period of validity stipulated on the card;
• the holder's photograph no longer corresponds to his or her current appearance;
• loss, theft or damage to the identity card;
• change of surname(s) or first name(s) and in the event of the addition or removal of the name of a living or predeceased spouse;
• change of identification number.

FEES FOR THE NEW IDENTITY CARD

The chancellery fee for an identity card is set by Grand-Ducal regulation at :

• 14 € for an identity card valid for 10 years (holder aged over 15) ;
• 10 € for an identity card valid for 5 years (holder aged between 4 and 15);
• 5 € for an identity card valid for 2 years (holder under 4 years old);
• 45 € for applications under the fast-track procedure.

The chancellery fee for the benefit of the State must be paid by the citizen before going to the municipal administration to the CCPL account indicated below (indicating first name and surname on the transfer). In the case of applications from several members of a family, it is possible to make a single transfer for the fees, but the proof of payment must indicate the first name and surname of all the persons concerned.

To obtain a biometric Luxembourg passport, Luxembourg nationals living in the municipality of Roeser should apply to the Ministry of Foreign Affairs via the Population Office of the Roeser municipal administration. The application must be made by the applicant him/herself.
When applying for a passport from the local authority, Luxembourg citizens are asked to provide proof of payment.

Notification of arrival

Any person who establishes their usual residence in the municipality of Roeser must be declared to the Population Office. The declaration must be made within eight days of arrival in the municipality. The declaration must be made by the person him/herself or by his/her representative.

The declaration must include surnames, first names, date and place of birth, marital status, sex, profession, nationality, address of chosen residence and date of entry into the municipality. It will also include the surnames and forenames, date and place of birth and place of residence or, where applicable, the death of the person's parents.

Documents to be presented :

• identity document
• proof of ownership, lease contract or certificate of cohabitation

Documents to be presented by a non-Luxembourg national (EU national) :

• residence permit or registration certificate
• valid passport or national identity card

Documents to be presented by a person arriving from a foreign country:

• a copy of the employment contract, a promise of employment signed by the future employer or proof of sufficient personal means of support
• the declaration of departure issued by the municipality of the former place of residence
• the driving licence, so that it can be validated in Luxembourg

Declaration of departure

- Any transfer of residence abroad must be declared to the Population Office by the person concerned or their representative.

- Change of address within the municipality:

Simply go to the Population Office to register a change of address, indicating the new address.

Documents to be presented :

• foreigner's identity card and registration certificate, if applicable
• proof of ownership, lease or proof of cohabitation at the new address

- Moving to another municipality in the Grand Duchy:

If you change your municipality of residence within the country, the municipal administration of the new place of residence will be responsible for deleting your name from the municipal register of the former municipality of residence.

EU citizens and members of their families

All citizens of the European Union or nationals of an ‘assimilated country’ (Norway, Iceland, Liechtenstein and the Swiss Confederation) wishing to stay in Luxembourg for more than three months must apply to the municipal administration of their place of residence within three months of their arrival to make a registration declaration. Family members who are Union citizens themselves must make the same registration declaration.


Documents to be attached to the registration declaration:

• a valid national identity document
• lease contract
• employees: employment contract valid for more than 3 months (dated and signed) by both parties or promise of employment (dated and signed) issued by the future employer; work permit valid for nationals of Bulgaria and Romania.
• self-employed workers: authorisation to set up or trade or a certified copy of the letter from the Ministry of Small and Medium-sized Businesses certifying that an authorisation to set up is not required for the activity carried out or a certified copy of the authorisation to practise (doctor, physiotherapist, etc.) or registration with the professional association (lawyers, architects, etc.) or a contract for the provision of services.
• students: enrolment in a public or private educational establishment approved in Luxembourg for the principal purpose of study or vocational training; guarantee of sufficient resources to avoid becoming a burden on the social assistance system; health insurance for themselves and members of their family, if accompanied.
• inactive persons: (persons who do not enjoy the right of residence under other provisions of Community law): proof of sufficient resources to avoid becoming a burden on the social assistance system, health insurance for themselves and their family members, if accompanied.
• Officials of the European institutions and NAMSA: The formalities to be completed are regulated by their personnel office, which is responsible for issuing a certificate of identity. The person concerned should preferably submit a copy of this certificate to the local authority in order to make the necessary entries in the population registers.
• extract from the marriage certificate / certificate of registered partnership / extract from the family record book / birth certificate

Family members who are third-country nationals should apply for a ‘residence card for the family member of a Union citizen’.

After five years' uninterrupted residence in the country, Union citizens are entitled to permanent residence. Family members who have lived with the Union citizen continuously for five years are entitled to a permanent residence certificate. Requests should be sent directly to

Third-country nationals

Any foreign national intending to stay in Luxembourg for more than three months must apply to the Ministry of Foreign Affairs for a residence permit before entering the country.

The permit must be used within ninety days of its issue, i.e. entry into the country and declaration of arrival must have been made before the expiry of this period. If a visa is required, the visa application must have been made before the expiry of this period.

Within three working days of entering the country, third-country nationals must present themselves with :

• a valid passport
• a residence permit issued by the Ministry of Foreign Affairs,
• all civil status documents (if these documents come from countries outside the EU, they must be legalised by the Luxembourg representation in that country),
• a lease contract or authorisation from the landlord to the Biergeramt, in order to make a declaration of arrival.

A copy of the declaration will be issued as a receipt. Possession of the receipt and the residence permit is proof of legal residence until the residence permit is issued. The person concerned must undergo a medical examination.

Within three months, they must apply to the Immigration Department for a residence permit.

A marriage may only be celebrated in the commune where one of the future spouses has his or her legal domicile, and the civil marriage must precede the religious ceremony.

One of the future spouses must go to the civil registry office to complete the marriage file. The registrar will give them the necessary forms and indicate which documents they need to provide. The documents required to compile the marriage file must be in French, German or English. If this is not the case, the future spouses must:

• either have them translated by a sworn translator into one of these 3 languages (a list of sworn translators can be requested from Guichet.lu);
• or request an international or national document from the competent authority in the country of origin, including legalisation of the signature or apostille (allowing a document to be validated and recognised abroad).

The required documents must be submitted to the registry office no later than 1 month before the date of the wedding.

Documents required to complete the marriage application

• proof of identity (photocopy of valid passport or identity card) ;
• a full copy of the birth certificate of the future spouses (indicating the names of their parents), issued by the commune of their place of birth. To be valid, this full copy must be less than 3 months old if issued in Luxembourg and less than 6 months old if issued abroad. If this record cannot be issued, the interested party may replace it with a notarised record issued by the Justice of the Peace of his place of birth or legal domicile, which must be approved by the District Court of the place where the marriage is to be celebrated. If the birth certificate was issued abroad, either an international certificate (in accordance with the Annex to ICCS Convention No. 16) or a national certificate with legalisation of signature or apostille (Hague Convention) must be produced.
• a certificate of residence, issued by the town hall of their place of residence. The marriage may only be celebrated in the commune where one of the future spouses is legally resident;
• proof of unmarried status (indicating marital status) attesting that the future spouses are unmarried. For Luxembourg nationals, a recent copy of the birth certificate drawn up in Luxembourg and a residence certificate indicating the civil status of the person concerned must be produced. For foreign nationals, proof of unmarried status is provided by a certificate of legal capacity to marry. If this certificate cannot be issued by the authorities in the person's country of origin, it may be replaced by a certificate of custom, supplemented by a certificate of celibacy. To find out which authority can issue these documents abroad, it is advisable to contact the commune of the last place of residence abroad or the relevant embassy.

Where applicable :

• the death certificate of the previous spouse ;
• the birth certificate of the children to be legitimised. If one or more children were born before the marriage and have not been recognised by the father (and/or mother), they must be recognised before the marriage takes place. This is because the child or children will not have the status of legitimate children if the acknowledgement is not made before the marriage. A duly recognised child is therefore automatically legitimised by marriage;
• the death certificate of the father/mother for minors;
• the marriage certificate with mention of divorce or transcription of the divorce decree.

Documents relating to divorce include :

• the marriage certificate mentioning the divorce or divorce decree concerning all previous marriages;
• divorce decree issued abroad: in the case of a decree issued before 1 March 2001 in a Member State of the European Union: have the divorce confirmed by an enforceable decree of the Court in Luxembourg;
  in the case of a judgment given after 1 March 2001 in a Member State of the European Union: have the divorce confirmed by the certificate concerning judgments in matrimonial matters (provided for in Article 39 of Regulation EC 2201/2003) duly completed by the competent foreign court or authority of the Member State of the European Union in which the judgment was given. This certificate must be written, dated and signed.
  in the case of a judgment handed down in a non-EU Member State (regardless of the date of the divorce judgment): have the judgment confirmed by an enforceable judgment of the Court in Luxembourg.

Information required to finalise wedding preparations

• parents' place and date of birth and place of residence. If one of the parents is deceased, the place and date of death must be given;
• the number of people attending the wedding;
• the address of the future spouses after the marriage.

Asylum seekers who are not yet recognised as residents in their own right must prove their current civil status with a certificate attesting to their status (issued by the Ministry of Foreign Affairs and Immigration - Directorate of Immigration) in order to marry in Luxembourg.

Special provisions concerning German nationals
The German matrimonial capacity certificate ‘Ehefähigkeitszeugnis’ is issued at the request of the civil registrar of the marriage commune in Luxembourg:

• by the commune of the last place of residence in Germany ;
• by the commune of birth ;
• by the Standesamt I Berlin if the person concerned has never lived in Germany.

Special provisions for Italian nationals
Person born and domiciled since birth in Luxembourg: marriage publications are made at the Italian Consulate, which will be informed by the civil registrar of the commune of residence. The interested party must submit a certificate of residence from all the communes in which he or she has lived in Luxembourg.
Person born in Italy: the marriage is published in Italy. The civil registrar will inform the competent commune via the Italian Consulate.

The person concerned must pay a fee to the commune in Italy.

Special provisions concerning Portuguese nationals
Applicants must present themselves together at the Consulate General of Portugal in Luxembourg, with the necessary documents, which are, in principle, the following:

• recent birth certificate (within 6 months) ;
• national identity card ;
• passport ;
• foreigner's identity card or residence certificate;
• parental authorisation for children under 18;
• Portuguese birth certificates showing current marital status.

The Consulate will publish the marriage at the Consular Chancellery and, if applicable, at the relevant Portuguese civil registry office, in relation to the residence of the parties concerned during the 12 months prior to the opening of the file.

Once the file has been completed, these departments will send the certificate of legal capacity to marry, together with the documents produced, directly to the relevant local authority.

Marriage files can be opened during local authority opening hours.

Two people of different sexes or of the same sex who are living together as a couple and who are capable of entering into a contract in accordance with articles 1123 and 1124 of the Civil Code may declare a partnership.

Declaration of partnership
The two future partners go before the civil registrar of their common domicile or residence and personally and jointly declare their partnership. The civil registrar will give them the forms to complete the necessary formalities.
The documents required must be in French, German or English. If they are not, the future partners must have them translated by a sworn translator. A list of sworn translators can be requested from Guichet.lu.

Essential documents to be provided
A number of supporting documents (to be translated into French, German or English if necessary) are essential for declaring a partnership:

• valid identity card for Luxembourg citizens ;
• Valid passport for European citizens and citizens of countries outside the European Union;
• recent certificate of residence from the commune of the place of domicile or residence certifying that the future partners have a common domicile;
• a full copy of the birth certificate of the future partners issued by the commune of their place of birth. To be valid, this full copy must be less than 3 months old if it was issued in Luxembourg and less than 6 months old if it was issued abroad; if it is impossible to obtain such a record, it may be replaced by a notarised record issued by the justice of the peace of the place of birth, or by the justice of the peace of the place of residence;
• for persons who do not have a birth certificate with a Luxembourg municipality: a certificate stating that neither of the 2 persons has registered another partnership with another person. Such a certificate may be requested by writing to the Cité judiciaire, Parquet Général, Service du répertoire civil, L-2080 Luxembourg (tel.(+352) 47 59 81-341), simply stating the surnames and forenames, marital status and address and enclosing a photocopy of the social security identification cards and identity cards or passports, together with the signatures of both partners;
• proof of celibacy (indicating marital status) attesting to the proven celibacy of the future partners. For Luxembourg nationals, a recent copy of the birth certificate drawn up in Luxembourg and a certificate of residence indicating the marital status of the person concerned (see above) must be produced. For non-Luxembourg nationals, the certificate of celibacy or marital capacity is issued by the competent authority in the country of origin, which may be, for example, the embassy or consulate of the country of origin in Luxembourg or the commune of the place of last residence in the country of origin. For countries that do not issue such a certificate, it is necessary to apply for a certificate attesting to the applicant's celibacy, known as a certificat de coutume. The certificate of custom may be drawn up by the municipality of the applicant's last place of residence, by the applicant's embassy or it may be a notarial deed;
• a sworn statement, signed by the partners either before the civil registrar or a notary, that there are no family or marriage ties between them that would constitute a legal obstacle to registering the partnership.

Where applicable :

• for foreign nationals: a certificate from the competent foreign authority stating that they are not involved in a partnership or other form of cohabitation contracted abroad;
  for divorced persons: a full copy of the dissolved marriage certificate mentioning the divorce or a full copy of the divorce transcript;
• for divorced persons: a full copy of the dissolved marriage certificate mentioning the divorce or a full copy of the divorce transcript;
• for widows: the death certificate or birth certificate of the deceased spouse mentioning the death;
• for people who had already entered into a partnership before 1 November 2010: a recent certificate from the civil register recording the dissolution of the declared partnership;
• proof of the existence of an agreement dealing with property effects, if such an agreement has been concluded between the partners.

The documents relating to the divorce are as follows:

• the marriage certificate mentioning the divorce or divorce decree concerning all previous marriages (if the divorce is not mentioned in the margin of the birth certificate).

Divorce decree issued abroad :

• in the case of a judgment given before 1 March 2001 in a Member State of the European Union: have the divorce confirmed by an enforceable judgment of the Court in Luxembourg ;
• in the case of a judgment given after 1 March 2001 in a Member State of the European Union: have the divorce confirmed by a certificate duly completed by the competent foreign court or authority of the Member State of the European Union in which the judgment was given. This certificate must be drawn up, dated and signed;
• in the case of a judgment handed down in a non-EU Member State (regardless of the date of the divorce judgment): have the judgment confirmed by an enforceable judgment of the Court in Luxembourg.

For persons whose birth certificate was drawn up or transcribed in Luxembourg, the declaration of partnership is mentioned in the margin of the birth certificate. This note indicates the place and date of the declaration of registered partnership and the contact details of the other partner. The mention of the partnership only appears on the full copy of the birth certificate, but does not appear on a simple birth certificate extract that a partner may have issued.
The conclusion of a property agreement is not required; however, it is possible. Such an agreement may be entered into at the time of the declaration of partnership or afterwards and may be amended at any time after that declaration. In the absence of an agreement, the declaration of partnership does create rights and obligations between the partners. The partners are obliged to provide each other with material assistance and to contribute to the expenses of the partnership in proportion to their respective means. They are jointly and severally liable to third parties for debts incurred for the day-to-day needs of their domestic community and for expenses relating to the shared home. Neither partner may, without the consent of the other, dispose of the rights to the common home or the furnishings therein. The partners may bequeath to each other a gift or bequest.

Interested parties are reminded that applications must be submitted during local council opening hours.

Deaths occurring in the municipality must be reported to the registrar within 24 hours. The person making the notification must produce a death certificate issued by a doctor and the deceased's family record book.
The registrar will draw up the death certificate and give the person making the notification extracts from the certificate, as well as copies of the burial and transport permits.
Burial must take place between the 36th and 72nd hour after death. This deadline may be extended by the Mayor on the advice of the Ministry of Health.

For the notification of deaths at weekends and on public holidays, a service is available from 09:00 to 11:30, tel. 36 92 32 2005.

All births must be declared to the registrar of the place of birth within five days of the birth; the day of the birth is not counted in this period.
The birth of the child will be declared by the father or, in his absence, by the doctors, midwives or other persons who attended the birth. The declarant must bring the family record book for legitimate children or identity papers for children born out of wedlock.

The child was born in another commune or abroad
If the child was born in a Luxembourg commune other than your commune of residence or abroad, you are advised to go to the commune of residence immediately after the birth certificate has been drawn up to have the child entered in the population register.

Applications to acquire Luxembourg nationality must be made to the civil registrar, who will give the interested party a form setting out the conditions for acquiring Luxembourg nationality and the documents to be provided.

1. A tourist tax is payable by people who have rented rooms or furnished flats in hotels, inns and guesthouses and who are not entered in the population register as being resident there. The landlord must collect the tax and pay it to the municipal authorities.
2. The tax is set at 3.00% (three per cent) of the amounts invoiced for the rental. If the rental price is included in a package comprising other services, the accommodation provider must declare the amount by which the rental is included in the package, without this amount being less than the normal rental price without services and, in any case, one third of the total price. Invoices issued to customers must bear a running number and a copy must be kept for inspection by the municipal authorities.
3. Every month, the landlord must submit to the administration, on a form drawn up by the college of aldermen, a declaration indicating the number of rentals granted, the amount of the sums collected and the amount of tax due to the municipality. The amount of tax due must be paid when the declaration is submitted.
4. Payment made following the declaration is accepted subject to all rights of verification.
5. The landlord is personally liable for the payment to the municipal tax office of the taxes that he has collected and those that he has culpably omitted to remit.
6. All operators are obliged to allow the supervisory agents delegated by the municipal administration access to their establishments and to submit to the control measures determined by the college of aldermen. In particular, he must provide them with rental rates, invoices and all books and other accounting documents required for the collection of value added tax due to the State.
7. The opening of a hotel, inn or boarding house must be notified to the municipal administration by the tenant three days in advance. In the event of abandonment or transfer of the business, the outstanding taxes must be paid without delay to the municipal revenue office.
8. The leaseholder will be held jointly and severally liable with the transferor for payment of the fees due prior to the transfer, in accordance with article 5 of these regulations.
9. Any breach of the provisions of these regulations is punishable by a fine of between 25 and 250 euros.
10. In the event of failure to present the monthly statement and refusal to pay the tax due, the municipal administration will automatically invoice an amount equivalent to 100% occupancy of all hotel rooms or flats.

Monday to Saturday, except public holidays, between 10.30am and 1pm. Sunday meals are delivered on Saturday.

The ‘Meals on Wheels’ service provides daily home delivery of a meal to any elderly person who has difficulty preparing their own meals. All meals are reheated by the customer using an induction hob provided by the municipality. A deposit of €150 is payable for the use of the equipment.

Aquatic courses

Registrations

The pool is not open to the public, but the SPIC organizes half-yearly (October to January and March to June) aquatic courses for residents of the three member communes.

Registration is for one semester, and takes place only on the dates and at the locations indicated on the registration form distributed twice a year to all residents.

Children with compulsory schooling are not admitted to classes.

If there are more registrations than places available, a course may be duplicated, subject to availability. Those concerned will be informed in writing of the day and time of the split course.

The syndicate reserves the right to cancel a course or postpone registrations to the second semester of the session. Those concerned will be notified in writing in such cases.

Room descriptions and online request

The Night Card costs €25 (for people aged 25 and under) or €50 (for people aged over 25). Exclusively reserved for residents of the Roeser commune, it enables them to take advantage of the Night Rider's services. The Night Card is only valid for journeys from the municipality of Roeser and/or to the municipality of Roeser.
